{"id":801,"date":"2019-01-11T10:36:06","date_gmt":"2019-01-11T14:36:06","guid":{"rendered":"https:\/\/menandabortion.net\/?p=801"},"modified":"2019-01-11T10:37:19","modified_gmt":"2019-01-11T14:37:19","slug":"south-african-political-party-acknowledges-fathers-lack-of-rights","status":"publish","type":"post","link":"https:\/\/menandabortion.net\/index.php\/2019\/01\/11\/south-african-political-party-acknowledges-fathers-lack-of-rights\/","title":{"rendered":"South African Political Party Acknowledges Fathers\u2019 Lack of Rights"},"content":{"rendered":"\n<p class=\"wp-block-paragraph\">In\na rare move to acknowledge fathers\u2019 rights, a newly formed political party in\nSouth Africa (Christians of South Africa) has called for fathers to be given\nsome legal power in abortion decisions.&nbsp;\nThe party\u2019s interim president, Derick Masoana, points out the legal\ninconsistencies faced by fathers in South Africa.&nbsp; Men who father children are legally required to\nsupport their children until adulthood but they are not allowed any legal power\nrelated to termination of pregnancy.&nbsp; In\naddition, while women are given three months maternity leave, men are allotted\na mere ten days.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The\narguments related to the lack of equality between men and women have been made\npreviously by legal scholars. In his review of legal cases and decisions\ninvolving paternal liability in the United States, George S. Swan (1975)\nwrites: \u201cThese decisions denying a paternal veto over abortion undermine the\nvarious justifications given by courts for holding fathers liable for their\nchildren&#8217;s care. The father&#8217;s coequal generative relationship no longer has a\nlegal counterpart: though the potential person is half his genetically, it is\nyet exclusively under the mother&#8217;s dominion legally as well as physically until\nbirth (p. 256).\u201d <\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Similarly,\nHiester (2004) argued that \u201cThe current law claims for a woman that which it\nrefuses for a man: the ability to choose parenthood.&nbsp; Instead, the law imposes parenthood on a man\nsolely as a result of the choice of the woman.&nbsp;\nAllowing a man equal protection by the ability to voluntarily terminate\nhis paternal rights may be distasteful, contrary to custom and history, and bad\npublic policy, but these are not legitimate reasons for refusing to give legal\nprotection to fathers (p. 241).\u201d<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">To\ndate, no man has been successful in either preventing an abortion against his\nwishes or in terminating his financial obligations to his child.
